1. Acceptance of Terms

Welcome to Aero Cab. These Terms of Service ("Terms") govern your access to and use of the Aero Cab website, mobile applications, and taxi services (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms.

Definitions:

"Aero Cab", "we", "us", "our"
Refers to Aero Cab taxi service, its owners, employees, and authorized agents.
"Customer", "you", "your", "passenger"
Refers to any individual or entity using Aero Cab services.
"Booking"
The reservation made by a customer for taxi services through any channel.
"Fare"
The total amount payable for taxi services, including base fare, tolls, taxes, and additional charges.

2. Service Description

Aero Cab provides taxi transportation services primarily between Vadodara and Ahmedabad, including but not limited to:

  • Oneway taxi services between Vadodara and Ahmedabad
  • Airport transfers to/from Ahmedabad Airport (AMD)
  • City taxi services within Vadodara and Ahmedabad
  • Car rental services for multiple days
  • Corporate transportation services

2.1 Service Availability

Our services are available 24 hours a day, 7 days a week, subject to driver and vehicle availability. We reserve the right to refuse service at our discretion.

2.2 Geographic Coverage

Primary service area includes Vadodara and Ahmedabad cities and surrounding regions. Services to other locations may be available upon request and subject to additional charges.

3. Booking Terms

3.2 Booking Confirmation

A booking is considered confirmed only when:

  • You receive a confirmation message from Aero Cab
  • Confirmation includes booking ID, pickup time, vehicle details, and fare
  • Payment terms (if applicable) are agreed upon

3.3 Booking Modifications

Booking modifications (time, date, pickup/drop locations) must be requested at least 2 hours before scheduled pickup. Modifications are subject to availability and may incur additional charges.

Note: Last-minute modifications may not be possible if the vehicle is already en route to pickup location.

4. Fare and Payment Terms

4.1 Fare Structure

Fares are composed of:

  • Base Fare: Calculated based on distance and vehicle type
  • Toll Charges: Actual toll charges incurred during the journey
  • Parking Fees: Applicable parking charges at airports or other locations
  • Night Charges: Additional ₹200 for journeys between 10 PM and 6 AM
  • Waiting Charges: ₹100 per hour after first 15 minutes of free waiting

4.2 Payment Methods

We accept the following payment methods:

  • Cash (Indian Rupees)
  • UPI (PhonePe, Google Pay, Paytm, etc.)
  • Credit/Debit cards (subject to availability)
  • Digital wallets

4.3 Payment Timing

Payment is due at the end of the journey unless otherwise arranged. For advance bookings requiring deposit, specific payment terms will be communicated during booking.

4.4 GST

All fares are inclusive of applicable Goods and Services Tax (GST) as per Indian tax regulations.

5. Cancellation Policy

5.1 Customer Cancellations

  • Free Cancellation: Up to 2 hours before scheduled pickup
  • Late Cancellation (2 hours to 30 minutes before): ₹200 cancellation fee
  • Very Late Cancellation (less than 30 minutes before): 50% of estimated fare
  • No Show: 100% of estimated fare (if driver reaches pickup location)

5.2 Cancellations by Aero Cab

We may cancel bookings due to:

  • Unsafe weather or road conditions
  • Vehicle breakdown or maintenance issues
  • Driver unavailability
  • Force majeure events
  • Suspected fraudulent activity

In such cases, we will provide alternative arrangements or full refunds.

5.3 Refund Processing

Refunds for eligible cancellations will be processed within 7-10 business days to the original payment method.

6. User Responsibilities

6.1 Accurate Information

You agree to provide accurate, current, and complete information including:

  • Correct pickup and drop locations
  • Accurate contact information
  • Correct number of passengers and luggage
  • Flight details for airport transfers

6.2 Passenger Conduct

You agree to:

  • Treat drivers and staff with respect and courtesy
  • Wear seat belts at all times during the journey
  • Not distract the driver while the vehicle is in motion
  • Not smoke, consume alcohol, or carry illegal substances in the vehicle
  • Not cause damage to the vehicle or its equipment
  • Comply with all applicable laws and regulations

6.3 Lost Property

Aero Cab is not responsible for items left in vehicles. While we make reasonable efforts to return lost property, we cannot guarantee recovery. Passengers should check the vehicle before exiting.

7. Driver and Vehicle Standards

7.1 Driver Requirements

All Aero Cab drivers:

  • Possess valid driving licenses
  • Have clean driving records
  • Undergo background checks
  • Receive training in customer service and safe driving
  • Carry required permits and documentation

7.2 Vehicle Standards

All Aero Cab vehicles:

  • Are regularly maintained and serviced
  • Have valid insurance and registration
  • Are equipped with air conditioning
  • Are clean and sanitized regularly
  • Have GPS tracking systems

8. Limitations of Liability

8.1 Service Delays

Aero Cab is not liable for delays caused by:

  • Traffic congestion or road conditions
  • Weather conditions
  • Accidents or road closures
  • Vehicle breakdowns
  • Any circumstances beyond our reasonable control

8.2 Maximum Liability

Our maximum liability for any claim related to our services shall not exceed the total fare paid for the specific journey giving rise to the claim.

8.3 Exclusions

Aero Cab shall not be liable for:

  • Indirect, incidental, or consequential damages
  • Loss of profits or business opportunities
  • Missed flights, appointments, or connections
  • Personal injury except where caused by our negligence
  • Loss or damage to personal property

9. Insurance

All Aero Cab vehicles are insured as required by Indian law. This insurance covers third-party liability and accidental damage. Passengers are advised to obtain personal travel insurance for comprehensive coverage.

10. Privacy Policy

Your privacy is important to us. Our Privacy Policy, which is incorporated into these Terms, explains how we collect, use, and protect your personal information. By using our Services, you consent to our collection and use of information as described in the Privacy Policy.

11. Intellectual Property

All content on the Aero Cab website and mobile applications, including text, graphics, logos, images, and software, is the property of Aero Cab or its content suppliers and is protected by Indian and international copyright laws.

12. Prohibited Activities

You agree not to:

  • Use our Services for any illegal purpose
  • Make false or fraudulent bookings
  • Harass, threaten, or abuse our drivers or staff
  • Damage or misuse our vehicles or equipment
  • Attempt to gain unauthorized access to our systems
  • Use our Services in a way that could damage, disable, or impair our Services

13. Termination

We may terminate or suspend your access to our Services immediately, without prior notice or liability, for any reason, including breach of these Terms. Upon termination, your right to use our Services will cease immediately.

14. Force Majeure

Aero Cab shall not be liable for any failure to perform its obligations under these Terms if such failure results from circumstances beyond its reasonable control, including but not limited to acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, strikes, or shortages of transportation, facilities, fuel, energy, labor, or materials.

15. Governing Law and Dispute Resolution

15.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions.

15.2 Jurisdiction

Any disputes arising from these Terms or your use of our Services shall be subject to the exclusive jurisdiction of the courts in Vadodara, Gujarat.

15.3 Dispute Resolution Process

Before initiating legal proceedings, parties agree to:

  1. Notify the other party in writing of the dispute
  2. Attempt to resolve the dispute through good faith negotiations for 30 days
  3. If unresolved, attempt mediation through a mutually agreed mediator
  4. Only after these steps, pursue legal remedies

16. Amendments to Terms

We reserve the right to modify these Terms at any time. We will provide notice of significant changes by posting the updated Terms on our website with a new effective date. Your continued use of our Services after such changes constitutes acceptance of the updated Terms.

17. Severability

If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced to the fullest extent under law.

18. Entire Agreement

These Terms, together with our Privacy Policy and Disclaimer, constitute the entire agreement between you and Aero Cab regarding the use of our Services, superseding any prior agreements between you and Aero Cab.
